Periodic Detention For Indecent Assault
The maximum term of periodic detention, 12 months, was imposed on Richard Lionel Tyson, aged 20, a timber worker (Mr K. N. Hampton), when he appeared before Mr Justice Wilson in the Supreme Court yesterday for sentence on a charge of in-; decent assault on a girl aged* 17 on February 20. His Honour said the offence was a serious one of its kind.; Tyson had originally faced a; charge of attempted rape, but’ the jury had failed to agree.' Tyson had pleaded guilty to. an alternative charge of in- 1 decent assault. “It seems to me that what you did fell short of attempted rape only in the fact that you intended to desist if the girl continued to resist," his Honour said.
Having regard to Tyson’s good work record, it was not his intention to send him to gaol or Borstal, and he had decided to impose the maximum permissible term of periodic detention “because I think it will impress on you that girls are not to be molested just as well as would being sentenced to the detention centre.” A term of 12 months pro-
bation, to follow the periodic detention term, was also imposed, and a special condition was that Tyson must live and work as directed. FURTHER REMAND
Appearing for sentence on a charge of. burglary and a charge of unlawfully getting into a car. John Lawrence Kingi, aged 35, a machinist (Mr J. E. Butler), was further remanded for three weeks for a psychiatric examination;
Kingi had pleaded guilty to the offences in the Magistrate’s Court and had been remanded to the Supreme Court for sentence. Mr N. W. Williamson appeared for the Crown. BANKRUPT DISCHARGED
Henry Timothy Harpur, a mechanic (Mr R. S. D. Twyneham), successfully applied for discharge from bankruptcy, and the discharge was granted immediately and Unconditionally. The application was opposed by Mr D. H. P. Dawson, for Donald Robert Muir, and by Mr A. J. Forbes for John Fenton Geayley, trading as Port Motors Lyttelton, Ltd. Mr J. B. Curran appeared I for the Official Assignee.
