The judges said that after reading the evidence and the record of the proceedings of the judicial committee, thev allowed the appeal on the grounds that no adequate opportunity was given to the appellant. Kevin Anthony Brophy, of Timaru. to be heard on the question of the disqualification of the horse.
They ordered that the deposit paid by the appellant be refunded. The appeal judges were Messrs C. S. Thomas (chairman), H. F. Butland and E. Somers.
Mr J. G. Leggat appeared for Brophy and Mr B. McClelland for the New Zealand Trotting Conference.
