NO LICENCE TO MARRY
Little Rock Ruling (N Z Press Assn.-—Copyright) LITTLE ROCK (Arkansas), September 8. Mr Michael Higgins, a Negro, and his white fiancee, Miss Susan Lane, said today they would seek legal advice on what steps to take after being refused a marriage licence. Mr R. S. Peters, the Pulaski County Clerk, refused to issue the licence on the basis of an 1838 Arkansas law forbidding the marriage of a white to a Negro. He said he was aware of the United States Supreme Court decision that overturned State laws against mixed marriages. But rather than run the risk of being convicted under the 1838 law himself, Mr Peters said he would refuse to issue the licence until a Court ruling applied directly to Arkansas. “I cannot go by what I read in the newspaper,” he said. Mr Higgins and Miss Lane, both Little Rock residents, refused to comment other than to say they would confer with a solicitor.
