MELBOURNE, Feb. 7.
An aborigine spent five weeks in prison for an offence unknown in law, the judge was told at the Shepparton General Sessions.
On January 5, John Athol Bond was convicted on a charge of habitual drunkenness, but when his appeal came before Judge Just yesterday, the Crown Prosecutor (Mr Geoffrey Byrne) said habitual drunkenness was not an offence in law. “The conviction should not have been recorded," the judge told Bond. “You were wrongly detained in prison. It is a great pity this happened, but I have no power to do anything about it.” Mr Byrne said the Crown solicitor was investigating the matter.
