APPEAL LOST
Claim For Damages
(N.Z. Press Association)
WELLINGTON, Dec. 8.
The Court of Appeal today unanimously dismissed the appeal brought by Horace Stanley Papps, a Christchurch company director, against the decision of the Supreme Court which dismissed his claim for damages against Peter Thomas Mahon and Jack McKenzie, partners in a legal firm.
Mr Justice McCarthy delivered the judgment of the Court today dismissing the appeal.
The Court comprised Mr Justice North, Mr Justice Turner and Mr Justice McCarthy. In his review of the facts Mr Justice McCarthy said that Papps had issued a writ against the defendants claiming “something over $22,600,” which was later amended to $15,600.
This was dismissed in the Supreme Court at Christchurch.
The appeal concerned only one matter relating to a sum of $2OOO. This sum had been transferred from Papps’s account by the defendants, then acting as his solicitors.
