NO DEFENCE WITNESSES
Weather-Bound In Tiri (N.Z. Press Association) AUCKLAND, Dec. 9. A motion for an interim injunction to prevent Radio Hauraki from copying or broadcasting recordings will not be heard in the Supreme Court at Auckland until some time in the New Year. An application in chambers for an adjournment was granted to the defendent company, Pacific Radio Advertising Ltd., today. A priority fixture will be given to the hearing in the next sittings of the Supreme Court beginning in February. The action is brought by Phonographic Performances (N.Z.), Ltd., which claims to be the exclusive licensee of the copyright of sound recordings in New Zealand. Mr R. L. Maclaren, counsel for the owners of Radio Hauraki, said today that one of the reasons for his application for an adjournment was that witnesses, including the managing-director of the company, Mr D. J. Gapes, were weather-bound in the Tiri. An undertaking had been given, he said, that in the meantime, records would be kept of royalties which could later be paid. The company had said it was willing to pay.
