“Prohibition” In Acts Both the Counties Act and the Municipal Corporations Act prohibited a council from making payment by cheque, according to an Electrical Supply Authorities’ Association legal opinion, received by the Kaiapoi Borough Council at its meeting last night. The opinion stated that similar clauses in each act were undoubtedly anachronistic. and were in conflict with specific statutory provisions relating to the use of chequesigning machines. “Nevertheless, they are still part of the law of the land, and an urgent amendment is called for to make it clear that the restrictive provisions do not affect the issue by local bodies of cheques,” the opinion said. The opinion gave the section in both acts: “Money not to be paid by promissory note or bill. All money paid or purporting to be paid by the council by promissory note or bill shall be deemed to be money unlawfully expended or applied within the meaning of the Public Revenues Act, 1953.”
