appeal Fails
An appeal brought in the Supreme Court by Leopold Friedlander, a Wellington importer, against a magistrate’s disavowal of his claim for £365 commission from a Christchurch handlbag-frame company has been dismissed by Mr Justice Macarthur, in a reserved decision. Friedlander had claimed that the Carlton Manufacturing Company, Ltd., had employed him as sales manager from July, 1962, to February, 1963, on a commission of 5 per cent of total turnover, which commission amounted to £365. Alternatively, he had claimed £3OO on a quantum meruit 'basis.
Friedlander claimed that, as part of the alleged agreement on his sales managership, the managing director of the company, Cart Julius Berger, was to sell him sufficient shares far a controlling interest in the company. His Honour held, in his decision, 'that the evidence did not show acceptance of Friedlander’s services by any person on behalf of the company, under such circumstances as would raise an inference that they were to be paid far. Mr R. G. Blunt appeared for Friedlander, and Mr E. J. Somers for the company, which was allowed costs.
