CLAIM ON ESTATE

Parties Agree On Order Mr Justice Macarthur in the Supreme Court yesterday adjourned an action brought by Clare Helen Morris, Of Greymouth, against the estate of her husband, William Percy Trillow Morris, a former bookseller, of Kaikoura, under the Family Protection Act. . • Mr R. G. Blunt appeared for Mrs Morris, Mr E. P. Wills for Peter Cyril Burnett, of Wellington, as executor, and Mr R. W. Edgley for Peter Burnett as a beneficiary, Mr E. J. Somers for Graham Eric Norman Rogers and Ernest Gildetoy Martyn Morris, both beneficiaries, and Mr I. E. Fitchett, of Nelson, for the residuary beneficiary, the Nelson Diocesan Trust Board. Mr Blunt asked the Court to award the plaintiff a lump sum of £lOOO, together with costs, Peter Burnett to pay the first £5OO and the balance, with the costs, to be taken from the residue of the estate. The plaintiff wanted to buy a house, and the award of a lump sum would assist her, he said. Messrs Edgley, Somers, and Fitchett said their clients consented to such an order. Mr Fitchett added that the residue of the estate would ultimately go to the church at Kaikoura. His Honour said that the order suggested was appropriate. He then adjourned the action to permit an order in the suggested terms to be submitted to the Court for approval.
