ACQUITTAL DIRECTED
Charges Of Indecency (N.Z. Press Association) AUCKLAND, March 23. On Mr Justice Richmond s direction, a jury in the Supreme Court at Auckland today acquitted Donna Mols, aged 20, dancer, and William Thomas Young, aged 41, night club proprietor, of alternative charges arising from Molss performance of an allegedly indecent dance at Young's premises in Newton in September last year. Mols and Young were charged jointly that on September 27 last year they wilfully did an indecent act in a public place—a house at 23 Day street, Newton—and that with intent to insult or offend persons present, they did indecently act in a nightclub at 23 Day street Each pleaded not guilty.
At the conclusion of the Crown case the Judge heard submissions from counsel in chambers. When he returned to the Court he told the jury that as a matter of law the words “the public” as used in the relevant section of the Crimes Act 1961, were not apt to describe the class of people who were permitted access to the house. He also said there seemed to be no evidence from which they could infer that Mols wished to insult or offend.
