Supreme Court CLAIM ON ESTATE
Settlement Reached
In the Supreme Court yesterday Mr Justice Macarthur approved a draft of settlement tendered by counsel concerning the estate of Victor Jubilee Rolton, a Halswell farmer. Rolton, who died on September 30, 1959, left his widow, Marta Rolton, a life interest in a house and four acres in Halswell road, subject to her paying the outgoings. The property was then to pass to his daughter by a previous marriage, Joan Thelma Woods.
When this case was first heard on Tuesday, Mrs Rolton asked to be relieved of the obligation to pay the outgoings on the property. Her counsel, Mr J. N. Matson, submitted that the property should be mortgaged so that there would be money available to pay for repairs. His Honour on that day commented that this was only a small estate, and that the parties should be able to work out a settlement between themselves. When the case was resumed yesterday, Mr Matson told his Honour that a settlement had been reached.
Mr C. B. Atkinson appeared for Mrs Woods, the second defendant, and Hubert Olaf Jacobsen, the trustee and first defendant, appeared in person.
