Magistrate’s Court Disqualified Driver Fined £40

If tlhe accused drove again while disqualified, he would go to prison, Mr E. A. Lee, S.M., said in the Magistrate’s Court yesterday to Kevin Aiborn Setter, aged 18. Setter, who pleaded guilty to a charge of driving while disqualified, was fined £4O. and his term of prohibition from driving was extended for a year.

Traffic Officer J. McLauchlan said that he stopped a car driven by Setter in Hereford street on October 12. Setter frankly admitted that he wa« prohibited from driving. "It is only your age that saved you from going to prison,” the Magistrate said to Setter.

For aiding and abetting Setter by lending him the car, John Johannes Doihmen. aged 18. was fined £lO. He pleaded guilty. RISKED COLLISION

Seconds before a train arrived. a power-cyclist crossed the Wilsons road level crossing. driving around a lowered barrier arm and ignoring bells and lights, Traffic Officer L. H. Wilkinson said, when the power-cyclist, David Tomlin, pleaded guilty to a charge of passing over the level crossing at the risk of a collision. He was fined £5.

The charge was reduced from one of reckless riding, to which he p’leaded not guilty. On a charge of failing to produce a driving licence, Tomilin was fined £2. SUSPENDED SENTENCE

Thomas Shearer, aged 41, who appeared tor sentence on a charge of being idle and disorderly in that he had insufficient means of support, was ordered to come up for sentence if called on within six months. Shearer said he would get a job, but he would not guarantee staying in it. “If you don’t get a job and stay in it, I’ll send you to a place where you’ll stay,” the Magistrate said.

Arthur John Henry, a process worker (Mr B. D. Field), was fined £8 on a charge of failing to stop at a traffic officer’s request in Linwood avenue at 12.40 a.m. on August 4. He pleaded not guilty. He admitted charges of exceeding 30 miles an hour and failing to obey traffic lights, and was fined £4 on the first charge and £5 on the second. CHARGE REDUCED

A charge against Neville Gordon Harlick, a student (Mr A. F. Wilding), of driving at a speed which might have been dangerous in Worcester street on July 26 was reduced by the Magistrate to one of careless driving. Harlick was fined £lO on the amended charge, and his driving licence was suspended for three months. He pleaded not guilty to the original charge. DROVE CARELESSLY

While driving along Manchester street, Michael Reynolds, a military trainee, swerved to miss a pedestrian and then turned sharply into High street travelling at 35 miles an hour, Traffic Officer B. Naiisbitt said. Reynolds stopped when he crashed into the back of a car at the High street and Hereford street intersection.

Reynolds (Mr N. W. McGillivray), appearing on a charge of careless driving, pleaded not guilty. He was convicted and fined £lO.

Reynolds said he did not swerve to miss the pedestrian because the pedestrian was not in a dangerous position. He admitted travelling 35 miles an hour. He said he was surprised when a traffic officer motioned him to stop. Because his attention was diverted, he crashed into the stationary car. (Before Mr K. H. J. Headifen, S.M.)

FINED £2 On a charge of failing to give way to the right, Gwendoline Sibylla Fuller was fined £2. She pleaded not guilty, and was represented by Mr W. A. Wilson. She was originally charged with careless driving, to which she also pleaded not guilty. The charge was reduced by the Magistrate. The charge arose out of a minor collision between two cars at the corner of Huxley and Colombo streets about 5.10 p.m. on July 15.
