Babbit Boards’ Liability (N.Z. Press Association) TIMARU, August 16. South Canterbury Federated Farmers will ask the Dominion council to seek an amendment to section 110 of the Rabbit Act, 1955, so that it does not exempt authorised persons who are negligent in their duties from normal liability. In sponsoring a Waimate remit to this effect at today’s meeting of the executive, Mr D. J. Hulston said it appeared from two Supreme Court rulings, one last year and the other in 1961, that, for example, in the event of sheep being killed through rabbit poison being dropped or laid on the wrong property, no-one could be called upon to pay compensation. A legal opinion had expressed the view that in the light of the rulings, rabbit boards could do almost anything with impunity. “This is not a crack at rabbit boards, because I understand some of them are greatly concerned at this possible loophole as far as insurance is concerned,” Mr Hulston said. The remit was carried unanimously.
