SETTLEMENT DEED
Court Allows Variation
In the Supreme Court yesterday Mr Justice Wilson allowed a motion for the variation of a deed of settlement under the will of George Humphreys, who died in 1918 The applicant was Clara Dorothea Humphreys, who was represented by Mr E J. Somers.
The first respondents, trustees of the estate, Clara Doro. thea Humphreys? Alan Maurice Duffield and Robert George Fitzharding Kingscote. were represented by Mr R M. Young. Mr B. McClelland appeared for the second respondent. Mrs F. A. P. Kingscote. and for Robert George Fitzharding Kingscote in his personal capacity.
Mr J. G. Leggat appeared by order of the Court for the third respondents, the infant children of R. G. F. Kingscote.
The proposition was that the applicant should surrender her general power of appointment in exchange for the payment of a sum of money, and that the trustees not possessing the money should have the power tc raise it.
In allowing the application his Honour commented that the order sought was a proper one, and was quite clearly to the advantage of both the applicant and the infant children.
