Magistrate’s Court Decision Reserved On Charge Of Falsifying Car Mileage

Decision on a charge of false pretences, involving the alleged winding back of the mileage on a car speedometer, was reserved by Mr A. P, Blair. S.M., in the Magistrate’s Court yesterday. Defence counsel (Mr A. Hearn) is to make legal submissions in writing, and the decision will be given tomorrow. Brian Ralph Remitter, aged 28, a mechanic, pleaded not guilty to a charge that, with intent to defraud, he obtained from Sydney Denne Marshall a cheque for £BOO by falsely representing that a Ford Customline car, sold to Marshall on September 1, was a privately owned car of low mileage. The hearing began on Friday. Detective-Sergeant J. P. Crozier prosecuted. Roy Lowrie Denton, a car salesman, of City Motors, Main North road, gave evidence yesterday that he took possession of a Ford Customline car at Invercargill and drove it to Christchurch. The mileage reading was about 93,000 John Joseph Crowe, manag-ing-director of City Motors, said that Rossitter approached him on August 19. He had a Triumph Herald car and wanted a larger vehicle. Rossitter took the Ford and paid £l5O after trading in the Triumph. On December 24, the witness said, he bought the same Ford from Marshall for £625.

To Mr Hearn, the witness said he valued the Triumph at £550, so Rossitter paid £7OO for the Ford. When he repurchased the Ford its mileage reading was 43,000. Neil Francis Stuart, a taxidriver and mechanic, said he had known Rossitter for about six years. He had never carried out repairs on the Ford.

In a statement made to De-tective-Sergeant L. D. Harrowfield, Rossitter said that he had the Ford for about three days before selling it to Marshall for £BOO. The mileage indicator on the speedometer was not working when he got the car. The accused said he had not interfered with the speedometer. It had been repaired by Stuart. Detective-Sergeant Harrowfield said that he saw Rossiter again on January 3 and told him Stuart claimed he had not touched the speedometer. The accused admitted he had not bought the car from a person in Invercargill, as he had claimed at first, but from City Motors. Giving evidence, Rossitter said he had never been convicted of offences involving dishonesty. Marshall had the car for three or four weeks before payment was made, and made no complaints about the car during that period. He valued the Triumph at £7OO, and when he bought the Ford he considered he was paying £B5O for it. When the Ford was sold to Marshall, the speedometer showed a mileage of about 40,000, Rossitter said. Marshall asked whether it was correct, and he said he could not guarantee it and told him to try the car. Rossitter said he denied on oath that he had wound back the speedometer. When he got the car the speedometer was not working because the cable had become loose at the top end. It was fixed by Stuart.

To Detective-Sergeant Cromer, Rossitter said he was an A grade mechanic. He was not a specialist in Ford cars, but had worked at the garage of the Ford agents for about two years. He did not have sufficient knowledge to alter the mileage on a'speedometer. It was a job for a specialist. Stuart was not correct when he said he had not repaired the speedometer. Evidence was given for the defence by three witnesses, who said that there was 40,000-odd miles on the speedometer of the Ford when it was in Roasitter’s possession.

O’Reilly), was convicted and discharged under section 42 of the Criminal Justice Act. Senior-Sergeant G. M. Cleary said that Hawker and his girl friend were standing outside the Plaza Theatre when the complainant walked up to them and said something. Hawker seized the complainant, who fell over. Hawker told a constable the had used obscene language. The complainant was arrested for drunkenness Mr O’Reilly said that Hawker had been shocked by the words used and pushed the complainant away. Had the complainant been sober he would not have fallen. DRIVER CONVICTED In a reserved decision, the Magistrate convicted John Richard Clarice, aged 43, a freezing worker, of driving in Yaidhurst road while under the Influence of drink or drugs on January 11. He fined him £3O, with witnesses' expenses £7 19s 6d, and cancelled his driver’s licence for three years. For driving without due care, of which Clarke was convicted on Monday, the defendant was ordered to pay costa, and his driver's licence was cancelled tor one year. Clarke (Mr G. R. Lascelles) had pleaded not guilty to both changes. The Magistrate said he found Clarke unfit to drive because of either drink or drugs or a combination of both. 14 DAYS’ GAOL Sydney Arthur Stringer, aged 80, was sentenced to 14 days' imprisonment when he pleaded guilty to being found drunk in High street on March 4, having been twice convicted of drunkenness within the previous six months.

STOLE CHAIR James George Darrell, aged 29. unemployed, was convicted and remanded on bail to March 8 for sentence when he pleaded guilty to the theft as a servant of a fibre-glass chidr worth £3 on or about January 30.
