FARMER BROKE NECK
£460 Damages Awarded (N.Z. Press Association) HAMILTON. August 2. A broken neck was suffered by a farmer, Andrew Edmond Geraghty Cathcart, of Onewhero, when he fell from a haystack he was topping on the farm of John Henry Miller, a farmer, of Onewhero, on January 13. 1960. As a result Cathcart claimed £2500 general damages and £335 special damages from John Williams Hull and Thelma Evelyn Hull, agricultural contractors, of Te Kohanga. and John HenryMiller. The case was heard this week before the Chief Justice (Sir Harold Barrowclough) and a jury in the Supreme Court at Hamilton. During the hearing the second defendant. Miller, was dismissed from the suit, the Chief Justice holding that he was in no way responsible for the accident. The jury today found that the plaintifl was 70 per cent, responsible for the accident and the Hull partnership 30 per cent., and awarded plaintiff £460 demages. The entry of judgment was deferred pending legal argument.
