MANSLAUGHTER CHARGE
Man Committed For Trial
<N.Z Press Association) HOKITIKA, May 23. Douglas Thomas Kelly, aged 23, a plumber, of Rimu. pleaded not guilty to a charge of manslaughter and was committed to the Supreme Court for trial, by Mr A. P. Blair, S.M., in the Hokitika Magistrate's Court today. Bail was fixed in his own recognisance of £5O and one surety of £5O. The charge was a sequel to a deerstalkr's death on March 24 when Kelly's companion. Paul Stuart, a timber worker, of Hokitika, was killed. Constable R. H. McMurray said that, accompanied by a field officer of the Acclimatisation Society, he had made tests of visibility in the bush He found that at the scene of the fatality he could not begin to distinguish the face of the field officer until he was 30 yards distant.
For Kelly. Mr W. D. Taylor submitted that he agreed some action was necessary to prevent these unfortunate deaths, but he did not consider that this was a case to send to the jury. It was a case on which no jury would convict
The Magistrate said that he agreed with a good deal that Mr Taylor had to say, but that he considered the case was essentially a matter for a iury.
