Magistrate’s Court Fifth Speeding Offence: Driver’s “Last Chance”

John Richard Dearsley Wade, a woolbuyer, was warned in the Magistrate’s Court yesterday that he had had his last chance on a speeding charge. Mr E. A. Lee S.M., said that if he appeared again, he would certainty lose his driver's licence. Wade was fined £lO and his licence was endorsed for two years. Wade pleaded guilty through Mr J. G. Hutchison to a charge of exceeding 30 milee an hour in Carlton Mill road and Hewitts road. Chief Patrol Officer J. Brown said that Wade was checked driving at 40 miles an hour along Carlton Mill road, and 45 miles an hour along Hewitts road. He had four previous convictions for speeding.

Mr Hutchison said that Wade was the manager of a woolbuying firm, and his car was very important to him Wade’s driving was hardly dangerous in the circumstances, he submitted. “I don’t mind how important you may feel yourself to be said,” said the Magistrate to Wade, “but anyone who drives at 45 miles an hour in city streets is unsafe. This is your last chance on a speeding charge." PASSED FIRE ENGINE Charged with exceeding 30 miles an hour on November 1, lan Lee was fined £6. Chief Patrol Officer Brown said that the Woolston fire engine, on its way at 3.30 p.m. to a fire at Sumner, was travelling 50 miles an hour along Ferry road with its siren going when a van overtook it jtrst before the Heathcote bridge. The engine continued along the causeway at 50 miles an hour but the van drev away and disappeared Its number was taken by the driver of the fire engine and his companions and reported to the City Council traffic department. EXPIRED METER Richard John Ahlfeld was convicted and discharged when he pleaded not guilty to a charge of parking in an expired meter space. Ahlfeld said in evidence that he had put two sixpences in the meter, expecting it to give him two hours' parking time. Frederick Hector Nyberg, aged 26, was convicted and sentenced to one week’s imorisonment. and bis driver's licence was cancelled for three years, on a charge of driving while udder the influence of drink or drugs in Dyers road on January 15. Nyberg pleaded guilty. Senior-Sergeant G. M. Cleary said that a traffic officer on patrol in Linwood avenue about 8 pm. on January 15 saw Nyberg turn his car from Linwood avenue into Dyers road, weaving from side to side as he did so. Nyberg got on to the right-hand side of Dyers road as he turned, and almost collided with an oncoming car. Nyberg, when stopped, was

unsteady on his feet, his eyes were bloodshot, and his speech was very slurred. He was certified by the police doctor, Dr. P. B. Mating, as unfit to drive.

Asked by the Magistrate whether he had anything to say, Nyberg said he Was sorry for what he had done, and, as he had a wife and two ’young children, asked that a fine might be imposed rather than a prison term.

“I don’t see any reason why the usual practice should not be followed.” said the Magistrate, in sentencing Nyberg to imprisonment. INTERFERED WITH MOTOR-CYCLE

Dennis Patrick Kerr, aged 22, a mechanic, pleaded guilty to a charge of unlawfully interfering with a motor-cycle, the property of R. Kernan, between November 24 and November 28. After a number-plate had been stolen from Kernan’s motor-cycle when parked in Barbadoes street, the accused was interviewed by the police about a numberplate found on his motorcycle, said Senior-Sergeant Cleary. Kerr was a disqualified driver at the moment, and other charges were pending. “You have a bad record," said the Magistrate in refusing Kerr bail, and remanding him to January 22 for sentence. REMANDED

Malcolm Donald Parker, aged 24, a workman, was remanded to January 22 on a charge of the theft of a man's gold dress ring, valued at £8 17s 6d, from James Pretty, Ltd., at Auckland, on July 7. Asked by the Magistrate about Parkier's position in relation to bail. Senior-Sergeant Cleary said that Parker was an Australian, and had no criminal record in New Zealand, but had “quite a substantial Australian history." Bail was allowed Parker at £75, with two similar sureties, Parker to report daily to the police Greta Ailsa Worthington, aged 50, a domestic, was remanded to January 22 on a charge of using indecent language in a public part of the Saxon Hotel, Lyttelton, on January 15. On the application of Mr J. G. Hutchison, who indicated that a plea of not guilty would be made, bail was allowed at £25, with a similar surety, the accused to report daily to the police.
