Magistrate’s Court Fines Totalling £6l For Two Traffic Offenders

Two defendants, one of whom was convicted on each of six charges involving traffic breaches and another who was convicted on each of four charges were fined £32 and £29 respectively in the Magistrate’s Court yesterday. These totals were exclusive of the Court costs and witnesses’ expenses which both defendants were ordered to pay. Mr N M. Izard, S.M., was on the JSench. Described by the prosecutor, Sergeant T. A. Marson, as a youth who was “quite irresponsible as far as motor vehicles are concerned” Brian Patrick Cummings, aged 18. pleaded guilty to all six charges against him. On a charge of driving without due care and attention he was fined £lO and prohibited from obtaining a licence for one month: for failing to stop after an accident he was fined £l5 and prohibited from obtaining a driving licence for six months; on two charges of driving a car without a licence he was fined £3 and £2 respectively; on two charges of having no warrant of fitness he was fined £2 and discharged respectively., Cummings had nothing to say when asked by the Magistrate. George Harvey, aged 43, was convicted and fined a total of £29 on four charges involving traffic breaches. Harvey did not appear. He was fined £l5 and his licence was suspended for three months on a charge of failing to stop after an accident; on a charge of driving without due care and attention he was fined £10; for failing to supply his. name and address he was fined £2; and for having no warrant of fitness a further £2. 28 DAYS’ GAOL

Errol Thomas Adam Sheehan, aged 20, was sentenced to 14 days imprisonment on each of two charges of driving a motor vehicle while he was disqualified on May 7 and 8.

Sheehan failed to appear when his case was called yesterday morning and the Magistrate issued a Bench warrant for his arrest and stood the case down to the afternoon.

Sentencing him the Magistrate said he had intended to make the sentences on the two charges concurrent; but because Sheehan had failed to appear in the morning he had decided to make the sentences cumulative. Sheehan wa on probation at the time of the offences and according to a probation officer’s report he was quite irresponsible. He was disqualified from obtaining a driving licence for a further 12 months. 73 MILES AN HOUR Described by his counsel.as one of the top four speedway drivers in Christchurch, Bruce Selwyn Savage, aged 23, a welder (Mr P. G. S. Penlington), was convicted and fined £lO and his licence was suspended for one month when he pleaded guilty to a charge of driving in a dangerous manner on the Main South road on May 31. Sergeant T. A. Marson, who prosecuted, said Savage passed a police car when he was travelling towards Christchurch and at times his speed was estimated at 73 miles an hour. Savage’s car was weaving in and out of the line of traffic and on occasions was three abreast with other cars.

Mr Penlington submitted that as a part-time speedway driver. Savage was accustomed to speed and at all times the situation was under control. On a further charge of having no warrant of fitness Savage was convicted and fined 10s. SEVEN DAYS’ GAOL

William Stewart Curry, aged 34, was convicted and sentenced to seven days’ imprisonment on a charge of obtaining credit by fraud

at Christchurch on July 3. Sergeant E. S. Tuck, who prosecuted, said that the charge arose from Curry’s inability to pay a taxi fare of £l. At the time he was “stupid and un-co-opera-tive” through drink. He had no fixed address, was not working and had previous convictions. DANGEROUS DRIVING Arthur Colin Dear, aged 21, was fined £lO and disqualified from obtaining a driving licence for two years when he appeared for sentence on a charge of dangerous driving at Christchurch on May 3. On a further charge of failing to wear a safety pelmet. Dear was convicted and discharged. The Magistrate said that Dear had previous convictions on traffic charges and other irresponsible actions. DISQUALIFICATION The defendant had made efforts to straighten himself and he would, by releasing him on probation, give him the opportunity to complete the process, said the Magistrate when Harry John Vickers, aged 19, appeared for sentence on charges of driving in a dangerous manner, driving while disqualified and wearing no safety helmet. All the offences were committed at Darfield on May 3. On the first charge he was admitted to probation for 12 months and disqualified from driving for six months, on the second he was disqualified from driving for 12 months and on the third he was convicted and discharged. The periods of disqualification are concurrent. REMANDED Norman Leslie Hutton, aged 44. a warehouseman, was remanded to July 10 on two charges of breaking and entering, one at Hastings on May 13 and one at Christchurch on May 17. Bail was not sought. TRAFFIC OFFENCES Traffic offenders. prosecuted by the police, were convicted and fined as follows: Negligent driving causing injury; Michael John Walsh, £l5 (licence suspended, prohibited from obtaining one for two years; no warrant, costs only). Failing to give way: Edward McNeil, £5; Ronald Edward Gilbert Barnfield, £5; Braemar Thomas Anderson, £5; Mabel Doris Hopkins, £3; Ethel Mary Tollemache, £5; Dorothy May Hamann, £5; Linden James Lowe Barnden, £7; Roy Charles Bonney, £5; Arnold Gerald Friedli, £5; Shona Joyce Jackson, £5; George Malcolm Smythe, £3; Bruce Moore Tinnock, £5. Driving without due care and attention; Davina Mertel Hay, £3; Louis Jackson, £5; Harold Lloyd Ayers, £5; Brian David Watts, £5; Daniel William Stribling, £5. No driver's licence: Raymond Gordon Lawrence Cherry, £3 (no warrant of fitness, £2). No warrant of fitness: Lionel Robert Stanilton Cross, £2; lan Neil Duncan, £1; Alister Leo Hong, 10s; Cyril Douglas Wilkinson, £2. Failing to notify change of ownership: Arnold Robert Colville, £5; Douglas Walter Hornsby, £5; Emblem John, Graham, £3. (Before Mr L. N. Ritchie, S.M.) FAILED TO GIVE WAY Walter Henderson Grant, aged 46, was ordered to pay costs on two charges of failing to give way at Southbridge on May 11, and having no driver's licence on the same date. Grant, who was represented by Mt A. C. Perry, pleaded not guilty to the charge of failing to give way. Sergeant E. Tuck said that the charge arose out of a collision between a truck driven by Grant and a car driven by Clement Rothery McLachlin at the corner of Faradays road and the Leeston-Soiithbriogc Main road. ( CHARGE DISMISSED A charge of failing to give way against Lawrence Rush worth, aged 36, a civil servant, was dismissed. Mr B. J. Drake, who represenieo Rushworth, entered a plea of not guilty. (Before Mr G. A. Nicholls, S.M.) CHARGE DISMISSED A charge of dangerous driving at Kaiapoi against Ronald Charles Barlow, aged 22 (Mr L. G. Holder), was dismissed.
