Judgment Against Owner Of Horse

(New Zealand Press Association) TTMARU, May 3.

After a retirement of four hours and a quarter, a Umaru Supreme Court jury today awarded John Telford Munro, a 50-year-eld Waitohi farmer, a total of £2751 9s 8d as general and special damages for injuries received when he was struck by a runaway horse at the Timaru A. and P. Show on October 29. 1955.

< Judgment was entered against fthe second-named Mrs Peggy Dunn, of Fairlie, the owner iof the horse. Mr Justice Henry presided. The jury awarded £lBOO as] general damages, and £951 9s 8d was fixed as special damages by : agreement. His honour allowed ’ costs according tc scale, disbursements and witnesses’ expenses to| be fixed by the Registrar. He certified for counsel's fees at 20gns a day for three extra days and second counsel at 7gns a day for four days. The hearing oc-: cupied four days. The plaintiff claimed £ 10.000 ! general damages and £ 12011 special damages, naming the' Timaru Agricultural and Pastoral Association as the first defendant and Mrs Dunn as the second : defendant.

On Thursday, his honour with-' drew from the jury the claim against the association, indicating' that he would determine later 1 whether the plaintive should be non-suited or whether judgment: should be given for the associa-: tion.
