Permitting use of unlicensed vehicle: Maurice Holmes, £l. Failing to stop at compulsory stop sign: James Lyon, £2. Exceeding heavy traffic licence: Reece Brothers, Ltd., £1 (no certificate of fitness for heavy vehicle, £1). CIVIL CASES (Before Mr L. N. Ritchie, S.M.) PARTNERSHIP ACCOUNT R. R. Shannon, a contractor (Mr G. G. Parry), proceeded against W. C Foster, for whom Mr M. G’. L. Loughnan appeared, for an order to wind up their partnership and for the taking of accounts. An order was made for the dissolution of the partnership and judgment was given for Shannon for £8 5s with DAMAGES AWARDED Frederick Arthur Woodham, aged 73 (Mr E. S. Bowie), claimed £2B 7s 9d from the Paramount Building Company, Ltd. (Mr J. G. Leggat), as damages resulting from a fall into an excavation for a drain in Woodham road on June 3. The Magistrate gave judgment for Woodham for £l5 general damages and £3 7s 9d special damages with costs. The plaintiff said that he and his wife cycled along Woodham road on their way to a card evening at the Linwood Tennis Club’s pavilion. He got off his bicycle opposite the pavilion and walked across the road where he fell into the excavation with his bicycle on top of him. He claimed that the excavation was neither lighted nor protected. The Magistrate said he accepted the statement that the plaintiff did look out. All that the defence could show was that l&tween 5 p.m. and 5.30 p.m. the lights were there, but there was no direct evidence on whether the lights vfere there at the time of the accident The plaintiff did fall into the trench and the defendant company had failed to discharge the duty it owed to the public.
