ASSAULT WITH KNIFE

DECISION RESERVED ON APPEAL (New Zealand Press Association) WELLINGTON, October 5. An appeal by Stefan Baraklinski, a Christchurch labourer, against his conviction for assaulting Peter Dalliessi, the licensee of the New Zealander Hotel, so as to cause him actual bodily harm, and against the sentence of imprisonment with hard labour for 18 months imposed upon him by Mr Justice Adams was heard by the Court of Appeal today. The Court comprised the Chief Justice (Sir Harold Barrowclough), Mr Justice Stanton and Mr Justice McGregor. Mr B. McClelland, of Christchurch, appeared for Baraklinski, and Mr W. H. Cunningham, of Wellington, for the Crown. Baraklinski was alleged to have stabbed Dalliessi in St. Asaph street, on the evening of June 23, 1954. He was found guilty of the charge by a jury in the Supreme Court at Christchurch on August 3, 1954. Decision was reserved by the Court of Appeal.
