MAN GUILTY OF COMMON ASSAULT
Francis William Windsor, aged 28, a tailor, was found guilty by a jury in the Supreme Court yesterday on a charge of common assault on a girl aged eight. As directed by Mr Justice Northcroft, the jury returned a verdict of not guilty on a charge of indecently assaulting the girl. The Crown Prosecutor (Sir Arthur Donnelly) prosecuted, and Mr W. F. Brown appeared for Windsor, who pleaded not guilty to the charge of Indecent assault and to the alternative charge of common assault. After the. evidence had been heard, Sir Arthur Donnelly told the jury that because the child had not said what she previously told the police had happened he could not ask for a verdict on the charge of indecent assault. But, he submitted, the evidence would convince them that there had been a common assault.
His Honour, in his summing up, directed the jury to bring in a verdict of not guilty on the first count against the accused, that of indecently assaulting the girl. He then went on to consider the alternative charge of common assault. The jury returned a verdict as stated.
