MAGISTRATE’S COURT

TUESDAY (Before Mr Rex C. Abernethy, S.M.) REMANDED ON MURDER CHARGE William Hainey Hillhouse, aged 20, a miner, was charged with the murder, at Runanga on August 12, of Margaret Rose Hillhouse. On the application of Detective-Sergeant G. W. Alty accused was remanded to appear at Greymouth on September 6. IMPRISONMENT Patrick Joseph Holmes, aged 27, a labourer, pleaded guilty to charges of converting to his own use, at Rakaia, a motorcar valued at £135, the property of Albert James; of obtaining £4 14s 2d in money and goods valued at 5s lOd from Thomas Victor Gibson, at Waixnate, by false pretences; and to obtaining £4 4s lid in money and goods valued at 14s 7d from Frank Wilson by false pretences. Detective-Sergeant Alty said accused had borrowed a cheque form at Rakaia and had filled it in to pay for five gallons of petrol. He had borrowed the car for two hours from James. He had abandoned it next day. He had a long list of previous convictions. “One of these days you will be declared a habitual criminal if you are not careful,” said the Magistrate, in sentencing Holmes to three months’ imprisonment with hard labour on the charge of car conversion. On each of the other two charges he was sentenced to one month’s imprisonment with hard labour,, the sentences to be cumulative with the first sentence. ASSAULT CHARGE Keith Murdock Kirkwood, aged 24, a soldier (Mr J. K. Moloney) pleaded guilty to a charge of assaulting Ivan Albert Foster. Detective-Sergeant Alty said that accused was a sergeant in the regular Army. With three other soldiers he drove his car to the city and later to the country. A quantity of liquor was consumed. At Kirwee accused met Foster, who had cycled from Burnham with two companions. They all decided to return to Christchurch, and accused agreed to carry the cycles on the back of his car. He did not drive the car, but sat in the back on Foster’s knee and committed an assault which, if the circumstances of the case had been different, would have led to a much more serious charge. Mr Moloney said Kirkwood had a good character and had not been before the Court before. His position in the Army was in jeopardy and that might be considered sufficient penalty. “Liquor is a bad master, as you- ought to have known and did know,” said the Magistrate. "Having regard to the probable effect of this offence on your status in the Army, you will be convicted and fined £5.” TRAFFIC OFFENCES In cases brought by the Transport Department, Mervyn John McNally was fined £2 for exceeding the speed limit.
