MAGISTRATE’S COURT

TUESDAY (Before Mr Raymond Ferner, S.M.) FALSE PRETENCES

Donaldson Tanihera Miller, aged 32, a cook, was convicted and placed on probation for 12 months on five charges of false pretences. Miller pleaded guilty to each charge.

He was charged with obtaining £7 from R. Cook and Son by falsely representing that a cheque drawn on the Bank

of Australasia and signed D. T. Miller was a good and valid order; with obtaining £6 15s from Maurice Valdemas Bernstein by falsely representing that a cheque drawn on the Bank of Australasia and signed D. T. Miller was a good and valid order: with obtaining from Pannell and Company, Ltd., goods to the value of £2 Ils 9d by falsely representing that a cheque drawn on the Bank of Australasia and signed D. T. Miller was a good and valid order for that amount; with obtaining from L. and M. Kerr £6 by falsely representing that a cheque drawn on the Bank of Australasia and signed D. T. Miller was a good and valid order; and with obtaining goods and money to the value of £5 from Millers, Ltd., by falsely representing that a cheque drawn on the Bank of Australasia and signed D. T. Miller was a good and valid order. Detective-Sergeant G. W. Alty said accused had opened a bank account last year and had issued 38 cheques, though he had only sufficient funds to meet half of them. He must have been aware that there was insufficient money as he had been warned by the bank. Mr B. G. Dingwall, who appeared for the accused, said that the charges were similar to those on which he was admitted to 12 months' probation in Dunedin. Since his conviction in Dunedin accused had made attempts to make restitution. The Magistrate in Dunedin had seen fit to grant probation to accused. The Magistrate said a long term of imprisonment was the usual sentence for such offenders, but as the Magistrate at Dunedin had seen fit to place accused on probation he would follow a similar course. Full restitution of the money was ordered to be made during the term of probation. TRAFFIC OFFENCES Fines were imposed, as follows in cases brought by the Transport Department:— Exeeceding speed limit: George Donald McNab. £2. No light on bicycle: John Arthur Watson, 20s. In cases brought by the Traffic Department of the Christchurch City Council fines were imposed as follows: — Parking over time limit: Hugh Barnett, 10s; John Herbert Brook, 10s; Alene June Caldwell, 20s; William Albert Edward May, £5; Robert Raymond Mortelier, £4; Henry Mansfield Read, 10s; George William Skellerup, 10s; Leonard William Walker, 10s (no warrant of fitness, 20s). Parking without lights: Trevor Theo Best, costs only; William Lambert Betteridge. costs only; Derek Turton Clement, costs only: Vallance Maxwell Holland, costs only; William Moor, costs only (no warrant of fitness, 10s); Noel Murphy, costs only (parking on incorrect side of road, 10s); David Samuel Phillips, costs only; Lois Mildred Rudd, costs only: parking on incorrect side of road, costs only); Bruce Stevens, costs only; Ronald lan Ward, costs only. Parking outside another parked vehicle: Russell J,ewis Blair, 10s; Harry Cornwall Joy, 10s. Cycling without a light: George Murray Turner, 20s. Failing to draw into kerb: Evelyn Pretoria Mary Gates, 10s. Parking in prohibited area: William John Charles Grant, 20s. Overloading heavy traffic vehicle: William George Green, £2 10s. Insufficient lights: Clifton Halliday, 30s. ' Exceeding. 30 miles an hour: lan Gra-1 ham Heasley, £2 (no warrant of fitness,! 10s; no L plates displayed, 10s); Norman Ness, £3.
