COURT OF APPEAL JUDGMENT
APPLICATION FOR PRIVY COUNCIL HEARING
, , WELLINGTON, April 21. A judgment of the Court of Appeal delivered or. December 8, 1949, upholding the claim of non-union waterside workers to a share in bonus payments made by the New Zealand Waterfront Industry Commission between September, 1942, and April, 1947, again became news this morning when the New Zealand Waterside Workers’ Union (Mr T. A. Gresscn, Christchurch) moved for conditional leave to appeal from the Court of Appeal judgment to the Privy Council.
Mr T. P. Cleary appeared for the Waterfront Industry Commission, while the successful appellants in the Court of Appeal, Jchn Alexander Bankier, Edward Deed and James* Duthie, all non-union waterside workers at Auckland, were represented by Mr H. A. Kennard, of Wellington.
Mr Kennard submitted that if the appeal was not of right then the Appeal Court should impose such conditions as to the costs as it saw fit. The Court, comprising the Chief Justice (Sir Humphrey O’Leary), Mr Justice Finlay, and Mr Justice Gresson, reserved its decision until Monday.
