HATBOX LOST FROM TRAM
PASSENGER’S CLAIM FAILS (P.A.) AUCKLAND, October 30. A woman whose hatbox and contents were stolen from a tram in which she was a passenger claimed £4O, which was the value of the property, from the Auckland Transport Board. Judgment in favour of the board was given by Mr J. H. Luxford, S.M., to-day. The plaintiff, Jane Munro, boarded a tram and put the hatbox in the passengers’ compartment in a place indicated by the conductor, said the Magistrate. The hatbox was subsequently missing, and the conductor recalled seeing a woman leave the tram with a hatbox. After a review of the legal aspects the Magistrate said it would be wrong to say in a case like this that a passenger was freed from all liability for the care of his or her property. The plaintiff was in a much better position than the conductor to keep an eye on the hatbox. especially at stopping places.
