MAGISTRATE'S COURT

• + THURSDAY (Before Mr A. A. McLachlan, S.M.) REMANDED Ronald Goslin, a labourer, aged 17, and Maxwell Gordon Southerwood, a labourer, aged 19, were charged with being rogues and vagabonds in that they were found by night without lawful excuse on the enclosed premises of Elsom's Service Station, 100 Oxford terrace. A remand till November 12 was granted. Roderick Joseph Brown, a labourer, aged 23, was charged with the theft of a quantity, of brush-making material, valued at £3, the property of Bunting and Company, Ltd. On the application of the police, a remand to November 12 was granted., CARRIED LOADED FIREARM John Swarbrick. a milkman, aged 27, was charged with operating a motor-car in which was carried a loaded firearm, without a police permit. . Sub-Inspector G. J. Paine said that accused had been a member of a shooting party. He had left a loaded .22 calibre rifle in the back of the car. Later, wheni the car stopped, the rifle fell out and was discharged, injurying a Mrs Warren in the face. Accused was convicted and fined £3. ESCAPED FROM PRISON , Peter Seaton Heye Young, a labourer, aged 19. and Alexander William Charlett, a labourer, aged 23, appeared on charges of having been deemed to be incorrigible rogues in that they escaped, on October 31, from a place of legal confinement, Faparua Prison. They were convicted and earh. sentenced to 12 months* imprisonment, the sentences to be cumulative to the terms they are at present serving.

BREACH OF PROBATION Bertram William Harold Borton, a labourer, aged 31, was convicted and discharged for the breach of a probation order. He also appeared for sentence on a charge of stealing,, on August 6, a diamond ring valued at £2O, the property of Dorothy Stilwell. On this charge Borton was again convicted and discharged.

ASSAULT ALLEGED Raymond James Hellyer, a labourer, aged 20 (Mr J. K. Moloney), appeared on two charges of assaulting Erwin Dyer Ritchie and Lewis Kerr Kerse, police constables, while in the execution of their duty. Hellyer was also charged with using- obscene language in a public place. Constable Ritchie said that he was arresting a man for drunkenness, and accused interfered. He struck witness on the mouth, necessitating the removal of three teeth. Constable Kerse arrived to help witness, and accused struck him also. Hellyer was convicted and ordered to come up for sentence if called upon in the next 12 months on the charge of assaulting Constable Kerse. On the charge of assaulting Constable Ritchie he was convicted and ordered to pav £2 restitution. On the charge of using obscene language he was convicted and fined £2. FAILURE TO REPORT ACCIDENT Gordon Bell, a fitter, aged 40 (Mr F D Sargent) pleaded guilty to a charge of failing to report an accident in which a car he was driving had been involved. He was fined £2.

ALLEGED CRUELTY. TO ANIMALS John Lehrs King pleaded not guilty to cruelly treating a dog. to doing mischief by damaging a dog, the property of Irene Bradbury, and to discharging a firearm without reasonable cause.

For defendant, Mr W. R. Lascelles said that the dog had bailed up one of his horses, which had broken into a junction of two fences and had its front hooves in a ditch. King admitted having shot the dog.

In dismissing the charges, the Magistrate said that King had taken a course more callous than was necessary. It would have b,een more manly and neighbourly if he had warned the Bradburys to stop the dog worrying his animals. FINES IMPOSED Harold Petheram pleaded not guilty to a charge of cruelly treating a dog, and pleaded guilty to discharging a firearm without reasonable cause. Petheram, for whom Mr A. N. Mackay appeared, said he was on his milk round when he shot the dog, which he had wounded. He said the dog had frequently frightened women and children, and was a menace! He had definitely intended to kill it. Accused was fined £2 on the first charge and £1 on the second charge. CHIMNEY. FIRE George Stanley Aylmer Bilteliff was fined £1 for allowing his chimney to catch fire. FINES FOR DRUNKENNESS . James O'Brien was fined 20s. in default 24 hours' imprisonment, for being drunk in a public place. Reuben Charles Wilfred Darling was fined £2 for drunkenness, in default 48 hours' imprisonment, and for the breach of a prohibtion order was convicted and fined £2, in default four days' imprisonment. LICENSING ACT Arthur John Joss was fined 20s for being found on the licensed premises of the Lancaster park Hotel after hours. -'■ Catherine. Young, proprietress of the Dominion Hotel, was fined £lO for selling IiOUOr after hours. For purchasing liquor from the Dominion Hotel after hours.
