APPEALS AGAINST SERVICE
DECISIONS OF NO. I BOARD The report of a primary production committee must be regarded as an expression of the opinion of the committee as a whole, and no member should be asked, when giving evidence, to give his personal views, said the Crown representative <Mr W. F. Tracy) during the hearing of appeals against service by two brothers, John Wilfred Rainey and Robert Geoffrey Rainey, before the No. 1 Armed Forces Appeal Board yesterday. Counsel had asked a witness, a member of a primary production committee, for his personal opinion, but the question was disallowed by the chairman of the board (Mr E A. Lee). Both the Rainey brothers are dairy farmers. They are grade 1. It had been suggested that one of the appellants, with the help of a third brother who Is unfit for military service, could carry on the work of the two farms satisfactorily without any appreciable diminution of production. This view was opposed by Mr C. P. Agar, a member of the Dairy Council, who had given evidence at f> previous hearing. In the case of both brothers the board reserved decision. NO. 2 BOARD An unusual case of a man protesting against his firm's appeal for him was heard by the No. 2 Armed Forces Appeal Board yesterday when Mr J. S. Barnett presided. The firm of Carbonic Ice, Ltd., was granted a sine die adjournment of its appeal for Eric Henry. Pithie, a process worker employed in the firm's Auckland factory, when the appeal last came before the board on June 21. A letter from Pithie, stating that he was engaged most of the time in processing carbonic gas for alcoholic beverages, soft drinks, and the dry-ice trade, and that an "infinitesimal proportion" of his time was spent on essential work, was received this week by the secretary of the board, Mr W. C. Mayson. Mr T. L. Uren. manager of the firm, which has ! its head office at Christchurch. declared, I when he appeared at. the last hearing of the appeal, that the Arm was then mainly engaged In producing carbonic gas for urgent and essential defence needs of the United States Navy. In reply to a statement in Pithle's letter alleging an over-sufficiency of staff in the Auckland branch, and stating thai he was seldom called on to work overtime, Mr Uren said that the factory there was working 24 hours a day, and that as the staff was organised in shifts there were few demands for overtime. The firm had spent more than £IOOO in the last six months on wages for men being trained to replace Pithie and other workers, said Mr Uren.
