♦ JUDGE’S DIRECTION (PRESS ASSOCIATION TELEGRAM.) DUNEDIN, February 2. A direction that it was not necessary for the Crown to prove against a motor driver, charged that while in a state of intoxication and in charge of a car, he, by act or omission, caused death, that the act or omission was negligent was given to a Jury to-day by Mr Justice Kennedy in the Supreme Court. Mr A. Hanlon; K.C., who appeared for the accused, asked if the Judge would be prepared, in the event of a conviction, to reserve the question whether the direction was good in law. His Honour replied that the application would be noted and discussed, if need be later. A further direction given was that the Crown was not bound to show the connexion between intoxication and Ihe act.
