APPEAL TO THE PRIVY COUNCIL
♦ COURT GRANT? LEAVE (rnrss association telegram;.) WELLINGTON, June 22. An application for leave to appeal to the Privy Council in the case Lyon versus the Public Trustee was heard by the Court of Appeal. The court was asked to decide whether the provisions of the Life Insurance Act, which exempted the proceeds of a policy or policies up to £2OOO from payment of debts, applied to the proceeds of a policy taken out by the deceased George Douglas Lyon in Scotland before he came to New Zealand. Mr Justice Ostler held that the proceeds of the policy were not exempt and that the New Zealand legislation did not cover them. The decision was reversed by the Court of Appeal, and application was made to appeal to the Privy Council. The court granted leave to appeal, provided the Public Trustee gives security and takes the necessary steps to procure the preparation of the record and the dispatch thereof to Ensland. The court adjourned till Monday.
