Whether the term "found" to describe persons on licensed premises after closing hours means found by a police officer, or whether the evidence of other persons that the defendant was there could be taken as proof of the fact, was a point on which Mr T. E. Maunsell, S.M., and SeniorSergeant Peterson found themselves at variance. The magistrate considered it was necessary for a person to be found by a police officer. He convicted and discharged the defendant concerned, who was proved to be found on the premises on the evidence of the licensee. In doing so he said he did not agree with the Crown Law Office on the matter, which should go to the Supreme Court for argument. The conviction, however, should not be taken as a precedent.
