A TRAVELLER'S INJURY.
CLAIM FOR COMPENSATION. £3O AWARDEP. The question of whether on accident which bcfel William Milner, traveller, in February last arose out of Ins employment was plficccj before Mr Justice Frajjer in the Arbitration Court yesterday for settlement. Milner sought compensation from J. Mercer find Sonx, Ltd., stating that ho hqd been incapacitated since the accident. His uveriiye weekly earnings beforehand were £l. Defendant company denied that the accident arose out of Milijer's employment and, as a further defence, said that if tho Court did find that tho accident arose out of the applicant's employment, then the incapacity did not last more than four weeks. Defendant also said that Milner luid failed to commence his action wjthjii the period of six months as required by law. With his Honour on the Bonch were Messrs W, Cecil Prime (employers' representative) and A. L. (employees' representative). In evidence Milner said that he had worked for the defendant cqmpany for two years before the accident. Since the accident he had suffered from attacks of forgetfulness and giddiness. William 8. Gripg, builder,_ said that Milner visited liini on the job when he was building a house. A piece ol wood fell on Milner, injuring bis head. •Dp. \V. F. Brown said that Milner had not recovered from the effects of the accident. Drs. R. U. Baxter and M, K. Gray also tpve evidence. "\Vo see mope of these cases than tho average doctor. Neurasthenia gives rise to oil sorts of fears as to the future—fears that are without foundation in fact," said his Honour in giving judgment for tho claimant. "In plain English neurasthenia moons sickness of the nerves. It does not mean that the mind is affected in any way but .the nerves cause the mind to play up. A patient generally imagines that ho is infinitely worse than is actually tho caso. Wc accept the medical evidence that there is no organic trouble. Tho claimant will bo awarded compensation amounting to £9O Is 9d."
