MAGISTERIAL

TUESDAY. (Before Mr E. I>. Mosley, S.M.) DRUNKENNESS. Two first offending inebriates were convicted and fined 10s each, in default -4 hours imprisonment. . EXPONENT OF DEMPSEY. William Adams, aged 26, and p 1 " 165 Arnell, aged 25, were charged with fighting in Cathedral square on Monday. Sub-Inspector Mathew said the two men were found lying in the Square with a crowd around them. Thev said they wore running," Adams showing Arnell how Dempsey could hit, and this developing into a real flgin. Each man was fined £2, in default U days imprisonment. SIX MONTHS' GAOL. William John Hardie, aged 22, pleaded guilty to a charge of stealing, at >gapara, goods and money to a total value of £l2, the property of Robert Allan Gray. Sub-Inspector Mathew said Hardie went to a hut owned by Gray and took a wallet from a pocket. He was at present nt Paparua gaol serving a sentence for another offence. "You can't be allowed to prey on the public," said the Magistrate in sentencing the accused to six months' imprisonment 'Witn hard labour. CHARGE DISMISSED. Cecil Davies, a milkman (Mr Tracy), was charged with the theft of a quart o£ milk and a milk bottle. , In the evidence, it transpired that defendant removed the bottle from a doorstep of a house, thinking a rival milk vendor had placed it there as a sample. He later found that the client had decided to deal from the rival vendor. The Magistrate dismissed the charge. ISSUED VALUELESS CHEQUES. William Scholes, aged 36, appeared on nine charges of obtaining money and goods by issuing valueless cheques. There was a further charge of attempting to obtain money with a valueless cheque. It was stated tttat tho accused had received goods and money, in change, to a total amount of £GO 9s Bd, the charges being laid over a period of three months. Detective Studholme read two statements by accused admitting the charges. He *aid that he spent tho money on food for his wile and family. , __, Scholes pleaded guilty on all charges, and was committed to tho Supreme Court for sentence. INSURANCE CLAIM.

Legal argument was heard on a claim by Henry Neale, of Springston, for £4l 15s from the Victoria Insurance , Company, the amount being alleged to be due for legal expenses incurred in the settlement of a claim in connexion with an accident. Mr Sim represented plaintiff, Mr Barrett appearing for the defendant company. Mr Sim said that tho company had paid the insurance claim by arrangement, but. refused to pay plaintiff's legal expenses in connexion with the claim. Mr Barrett contended that the company should pay only legal expenses to the incurring of which they had agreed. The Magistrate reserved judgment, but intimated that his judgment would be for plaintiff, though not for the full amount.

Mies F Morton was ordered to pay K. H. Fountain, dentist, £9 19s, in default 11 days in Addington prison., VULCANISER'S CLAIM. -A. Willoughby, vulcaniser, ;•- Chrifttihuich (Mr W. F. Tracy), 'claimed from land agent, Christchurch, £i;4s'lod, said to be due for tyres sold and delivered by plaintiff. Peverill counter-claimed for £1 IBs 6d which was said to represent the loss sustained by him through plaintiff delivering two ply tyres instead of four ply tyres. Judgment was given for Willoughby on the claim and counter-claim, FARMER SUED. James Carter and Sons, Ltd., Christchurch (Mr H. H. Hanna) sued E. Heyward, farmer, Clarkville (Mr W. F. Tracy), for £l4 6s 9d for work done and materials supplied on the instructions of defendant's agent.. J. Boyce, in connexion with the repair of a'tractor owned by the defendant. After hearing evidence, the Magistrate ertered judgment for defendant with costs. FOE GROCERIES. H. McMillan, storekeeper, Chaneys (Mr H S Ji Goodman), claimed from Arthur E. Boxall, farmer, Chaneys, £25 for groceries supplied. ,■>.■* „-.n, Judgment was given for plaintiff with CO9tS " CLAIM FOR RENT. The State Advances Superintendent sued J J. Kinsella, carrier, Christchurch, for £1 19s. -being the amount owing for rent Judgment was given for the plaintiff for the amount claimed with costs.
