MISSING WIFE

AND DIVORCE ACTION. ; CO-RESPONDENT SUSPECTED. | (srzeut to THu rprss.) AUCKLAND, Juno 21. An application for the dismissal of a ! divorce petition was made in the Supremo Court by William Gilbert, of To Kuiti (Mr G. P. Einlay), who was citod as co-rospondoit, in a petition by William Johnston (JJr Noble), against Hilda Olive Johnston. Mr Einlay said tho petition had been lodgod at Hamilton some time ago, and had repeatedly failed to come before the Court. The co-respondent was a perfectly reputable citizen, and ho wished that there should bo finality, and that the case should not be kept hanging over his head. Mr Noble opposod tho application, and said the delay was due to petitioner's lack of money. Kcspondent had loft homo and deserted two young child' ren. Every effort had been made to locate her, but it was believed she was travelling under an assumed name. Counsel said'ho suspected co-respondent know where respondent could be found. It would bo improper to dismiss a petition at a co-respondent's request. His Honour; Must ho be kept' indefinitely under the stigma? Mr "Noble; I have ample evidence that ho does not come into Court with clean hands. I can prove that this man walked into petitioner's house at mid' night, His Honour: You are assuming he knows whore to find the respondent. I will give you an opportunity to place tho evidence on affidavit, and you might thou apply for substituting service of petition on respondent. The case was adjourned for fourteen days. '
