BREACH OF TRUST ALLEGED, (PRESS ASSOCIATION TBLEGBAjr.) NAPIER, June 91This morning, at the Supreme Court, before Mr Justice Reed, tho hearing was commenced of a. case in which Ida. Tawse, one of the bonoficiariea under the will of tho late H. J. Glazebrook, sheep-farmer, brought an action against Henry Gasgoyuo, Howard Grln?cbrook, and W. G. Wood, trustees of the estate, claiming accounts, removal of executors, and damages through improper sale. Plaintiff was represented by Sir John Findlay, K.C., with Mr 11. Grant, and defendants by Mr Gray, K.C., with Mr H. B. Lush. The testator left among hia properties a valuable sheep farm, known as "Washpool," 2713 acres, to one son and-six daughters. At a meeting of trustees it was decided to sell, contrary to the beneficiaries wishes, at £l9 6s 8d per acre, whereas the property wa& valued at £3O. Sir John Findlay, in opening, said it was a case in which the plaintiff Bought relief through a breach of trust. Tho executors had been given amplu power under tho will to continue working the property as. a sheep farm for two yoars, and unanimously decided to do so, but later, through pressure by the mother, some of the daughters, and Howard Glazebrook, the executors gave way, and effected a.aale at the Government valuation. Counsel guoted ot length from accounts of meetings of trustees and beneficiaries, his address lasting four hours. The case will last several days.
