CLAIM FOR DAMAGES. G. D. Caldwell, labourer, of Courlensy (Mr "W. Tracy) claimed from Victor Fogarty, Canon street, Christchureh (Mr E. White) the sum of £39 la 6d for damages arising out of a collision on tho road from Christchureh to Aylesbury, on October 25th last. Plaintiff's claim was made up of damages to motor-cycle £ls, loss of three weeks' wages £lO 16s, tjeneril damages £lO, damago to clothes £2 10s, hospital expenses 15s 6d.

Plaintiff said that ho. was driving 1 a motorcycle and side-car into Ckristchunch from Courtenay. He was travelling _at from' IS lo 16 miles an hour, .and. as-'ho reached Church Corner, Courtenay, defendant canw out of the road *it 25 mileß am hour and crashed into him. He heard no warning and defendant was on his wrong aide of the road. He had no chance of setting out of the way, and his cycle and side-car were overturned. • Defendant also was driving a motor-cycle. < \ Plaintiff oaid that the fact of his machine and side-oar capsizing was not. duo to his epeed, when replying to a eugeestion for the defence that no collision had occurred. He waa sure Fogarty's motor-cyolo hit his. ■

George Seaton, farmer, said that Fogarty's motor-cycle hit plaintiffs side-car. Victor Fogarty, the defendant, eaid that he was travelling at About 15 miles an hour,? and Caldwell was- soing at from 30 to 40 milea an hour. There, was no collision at all, but he saw Caldwell's outfit capsize. The Mngistr&to said that he was. of the opinion that the defendant's machine did strike plaintiff's aide-car. Judsment was given for the plaintiff for £32 11a 6d and costs £4.
