(Before Mr T. A. B. Bailey, S.M.) DRUNKENNESS.

William Dowries was remanded for a wrok on a charge of drunkenness, ana , a first offender till to-morrow morning. RESISTING" ARREST. James Oliver pleaded guilty to charges of drunkenness, resisting arrest, and doing damage to the extent of 25s to Constable Hislop's Accused Tras convicted on the charge of drunkenness, sentenced to seven days' imprisonment for resisting arrest, and ordered to pay the- amount of damage to the trousers, in default seven days' imprisonment. ALLEGED THEFT.

.Robert Gray, alias Leonard Parker, was charged with having, on January 10th, at Wellington, stolen a suit or clothes, value £3 10s, the property of George Steel. Chief-Detective Bishop asked for a remand, as there were other charges pending. Accused was remanded to appear at Wellington to-morrow morning. JUDGMENT BY DEFAULT.

John McNeil, £5 10s; E. Beardsley and Son v. Robert Massoy, £2.

A DAMAGED HOUSE. Ellen Brown Cuff (Mr Cuningham) claimed from William Francie Roche and Lilian Roche, his wife. £3 3s 9d damages alleged to have been sustained by reason of the untenantlike and improper use'by the defendants of si bouse situated in Bealey avenue, of which the defendants •wore tenants from Juno 28th, 1911, to April 16th, 1913. t After hearing the evidence, his "Worship gave judg'.ncut against the malo defendant for £1 Is 9d. CLAIM FOR POSSESSION.

Haywurd's Picturo Enterprises, Ltd., and the Globe Continuous Pictures, Ltd. (Mr Anthony) claimed to recover from Augustus Reid Pavitt and John Preece, trading as Pavitt and Prcece, land and estate agents (Mr Grcsson) possession of the premises in High street, being portion of the Globe Theatre occupied by deiendants and rented from the plaintiffs under a tenancy at will. Plaintiffs also claimed the sum of £7 for ront of the premises from December 22nd. 1913. to February 9th. 1914.

Mr Anthony said" that Harold McNelly, who . had been appointed manager of the Globe Picture Theatre, was instructed to let one of the boxes in front of the theatre. He was told not to enter into any contract, but to lot the box on a weekly tenancy. In defiance of theso iinstructions ho let the box to the defendants lor twelve months at a rental of £1 per week, ■with the option of renewal for five years. He had no authority to let the liox on a lease, but it was suggested that defendants could keep on the tenancy from week to week. In November last they -were given notice to terminate their tenancy on December 21st.

Alfred Rowley and Percy A. Herman gave evidence in support of counsel's statement.

Mr Gresson moved for a non-suit. He said that tho Magistrate's Court had no jurisdiction in the matter, and that plaintiffs must go to tho Supreme Court for a writ of ejectment. Tho wholo question was whether McNelly had authority to enter into a lease, binding his principals.

His Worship refused to grant a nonsuit, and after evidence had boen given by A. R. Pavitt and Harold McNelly. decision was reserved.
