MAGISTRATE'S COURT.

JUDGMENTS BY DEFAULT. Mr H. W. Sydenham Borough Council v Mary Jane Smith, claim £3 5s sd, ooete ss. Same v Edith Colfomfous, claim £1 11s 9d, coste ss. Same v Antonio Di Rago and Frances E. Di Rago, claim £2 10s 7d, costs Bs. Moir and Co. v James Miles, claim £2 2b 2d, coste ss. Jane Caroline Low v C. H. Partridge; claim £50. Mr Russell for plaintiff. MONEY-LENDING TRANSACTION. William Aeh, livery stable-keeper, sued John Wilson for the return of a landau or £50, its value, the landau having been seized under, an alleged bill-of-eale. Mr Leathern appeared for plaintiff, '■ and Mr Beatty for defendant. Ash stated that he had borrowed £12 as a loan from Wilson through H. E. Boardman, a bailiff.. On the other hand, Wilson swore that'ihe pur-, chased the vehicle for £12, and then hired it out to Ash at 30s per month. Only £1 Hind been paid, but when Ash woe having the landau repaired, with a view of selling it, it was seized on Wilson's behalf. One witness swore the landau was worth £30, and another that it was worth £50. Mr Beatty asked for a non-suit, arguing that there was no case irjder the claim, the fact of .possession and the document signed by Aeh being sufficient for defendant to maintain liis claim and right to the vehicle until the money • owing_was properly tendered. '_ H. E. Boardman gave evidence corroborating defendant's statement. Mar Leathern ao-gued titat. th« document void. Judgment was reserved.
