ALLEGED BREACH OF PROMISE.

A PECULIAR CASE

I AUCKLAND, September 15. In the Supreme Court to-day; Agnes Hendry, a domestic servant, sued Frank Edward Brooker, pork butcher, of Otahuhu, for £250 damages for breach of promise of marriage. The plaintiff said she had been engaged to defendant for nearly three years. In the early part of tills year she lived for three months with the defendant's brother, who was defeirdant's partner in business. After she caoie to town defendant did no* write, and she went to Otahuhu and saw him. He said: —"Yes; I'm tired of yoa. I don't want to get married." He said his relatives didn't like her, and he could not think of marrying one they disliked, and that she should go and see his brother. She did so, and his brother said, in Frank's presence, that Frank was either to stick to his business or stick to the plaintiff—he must give up one cr the other. Eight lettera were handed in. One began: "My dearest, sweetest Agnes." In his last letter, dated June 2Bth, Brooker said it would not pay him to fall out wkh Tom, as he could not afford it. He waa not in a position to marry at present. His Honour, after perusing the letters, said they were love letters, but there was no promise of mamage in -them. Tlvere must be some .material corroborative evidence as to the promise of marriage. A love letter was no proof of a promise to marry. Mr Bamne, for the plaintiff, stated that the plaintiff's sist«r was on her way to town, and could give corroborative evidence. The case was accordingly adjourned till Monday.
