DUNEDIN, December 9. , The Tahuna Park Trotting Club resumed , the enquiry into the complaint made by , Clarke, the late trainer of the trotter Cling, j that Rutherford, the owner, had not sent the J correct performances with the nominations, of the mare. It was resolved that the correct performances were not handed in, but the Committee exonerated Rutherford, the owner, from any intention of fraud, but the 1 omission having been made, the Committee * request Mr Rutherford to refund the stakes won'by Cling at the Autumn and May meetings, and that the same be paid to the owners of the horses placed second. It was resolved to disqualify Clarke, the late trainer J of Cling, for two years- In explanation of \ the disqualification, the evidence of Ruther- \ ford was to the effect that Clarke, who sub- ] sequently informed the Club of omission, J dictated the mare's performances when he (Rutherford) was filling the entry form.
