RACING DISPUTE.

THE WELLINGTON CUP PROTEST. (PRE3S ASSOCIATION TELEGRAM.) WELLINGTON, January 29. The owner of Saracen, whp ran second in the Wellington Cup, claims the first money on the ground that Mr Quinlivan, who nominated the winner Brooklet, instructed the Secretary to ecratoh the mare, whioh was therefore ineligible to start. Mr Quinlivan formerly leased the mare from Mr Douglas, of Hawke's Bay, but the latter recently took her back, and ahe raced at the Hutt in his intereet. NAPIER, January 28. The civil case T. Quinlivan v W. Douglas is set down for hearing in the Supreme bourt in February. The claim is for £2679, the plaintiff alleging that defendant illegally took possession of the Wellington Cup winner Brooklet in the face of an agreement giving him the use of the mare as long %s she could race. (9ROII OUR OWN CORRESPONDENT.) WELLINGTON, January 29. Mr T. Quinlivan has commenced an action against Mr W. Douglas for wrongfully taking Brooklet out of his hands, and Mr H. M. Lyon, secretary W.R.C., has been notified to hold the stakes of the Wellington Cup pending the result of the case. Mr Lyon has also received a protest from Mr R. Allen, owner of Saracen, who finished second to Brooklet, couched in the following terms :—" I beg to protest against Brooklet getting the stake in the Cup on the following grounds—Brooklet was first nominated by one Quinlivan, who subsequently scratched the, mare for her engagement in the said Cup. She was therefore not eligible to run, your club having accepted Quinlivan's nomination for the said more. I contend that they must also accept the scratching of her from him. I therefore claim the stake for my horse, Saracen, who was placed second." The stewards will consider the protest probably this week, but no later than Monday next. Mr Lyon states that Mr Quinlivan desired to ecratoh the mare for her second day's engagement after the Cup was decided, but not for the Cup, but the secretary would not recognise Quinlivan in the matter, as he had received notice from Mr Luckie, Mr Douglas , agent, only to take instructions from George Hope, who was in charge of the mare. It appears that Quinlivan nominated and accepted for the mare, but Hope made the final payment.
