The charge against Ellison, a solicitor tf being concerned iv un illegal operation w_ resumed to-day. Mr Gray, for the Crown wishea to ptovo a system on the part of Brown, who, at the late sittings of ths Supreme Court, was sentencod to eighteen years' hard labour on the same charge. Mr Martin, S.M., ruled that such evidence w_ inadmissible. At the conclusion of the cvi donee Mr Gray applied for a remand until the application by Brown to the Attorney General for a new trial in his case wai decided. Mr Skerrett, for tho accmed strongly objected, as he contended that no prima facie case had beeu made out aga\n S |. Ellison. Mr Martin said he woula grant the remand. It must be remembered that it was with the consent of tho accused that tha case had been ho far adjourned' There was a person who held the key to tho case, and could eithet clear the accused or convict him Brown's objeotiou to give evidence was a! bona fide one, and the initiatory steps had already been taken to apply to tho Court of Appeal. It was iv the interests of justice that an opportunity should be given to the Crown to call a witness who could praoti. cally decide the case. Tho accused was remanded for a week.
