THE ACTION AGAINST THE MAYOR.
At the Resident Magistrate's Court, Christchurch, yesterday, Mr Beetham, R.M., gave judgment in cases heard on a previous day against Eden George for allowing meetings to be held on Sundays in the Tuam street Hall, of which he was the person having control. Mr .fisher appeared to prosecute for the City Council. Mr George conducted his own case in defence. Mr Beetham now. said:— " The .question in this case is, can the Council issue a license under section 401 of the Municipal Corporations - Act, 1886, subject to certain conditions. I think the Council cannot annex conditions which the Legislature has not imposed. If it were intended that the Council should have the power to annex conditions then the provisions of section 404 would be unnecessary, and power would have been given to suspend the license if any conditions under which it was issued were
broken. All the Council can do is to issue a license for a certain period, and should they refuse to issue there is an appeal given to applicant. As to the defendant having no license, he has one ; it may be good in part and bad in part; he can eliminate the bad and use the good. The informations are dismissed."
