Civil Cases,—Weatherall v. Bowmaa, claim £10, for alleged assault in ejecting the plaintiff from defendant's auction rooms. Mr Seattle for plaintiff, Mr Kip* penberger for the defendant. The evidence had been heard on Taesday c and now after argument his Worship said that the plaintiff had been invited as one of the public to attend an auction, and not having misbehaved himself on the occasion the defendant had no right to cause him to be put oat. There had. been a technical aasaulfe committed, and as the actiou had apparently been to try a right, be would treat it as such, and fine defendant £1, with costs £3 6s; at the same time defendant might, if he eios®. go to appeal. Mr Klppenberger e&la he would appeal. Kemp v Aynses, claim £610s, Mr Kippenberger for plaintiff, Mir Russell for defendant. Plaintiff stated that in 1888 he stripped for defendant twenty-six acres of grass seed, for which he was to be paid 5s per acre. Subsa* quently he agreed to take bushels o£ deea grass seed per acre for bis work lv« steau of cash. The seed offered, to him was very dirty, and he refused to accept It. He had not been paid otherwise, and now sued for the amount as originally agreed on. F. W. Kemp, plaintiffs son, gave corroborative evidence, and the ease was then adjourned till March 17tb, for the attendance of .defendant and argument. Judgments went for plaintiffs by default, with costs hi Nelson, ideate ana Co. v Levy, £36 5s 8d; B*U«y v Jarrla, £19 17s 6d: and Ohristchurcn Bulldlojl and Loan Sodtbty v Ankins, £2' im GC Rollltt and Co. v. Thompson, Hatch add Co., and Stillwell v Hall, were adjourn®* till March 12tb.
