Tuesday, December 28.
I Before C. Whitefoord, Esq, R.M.J Police Ordinance.—E. Murfit, arrested on warrant by Mounted-constable Smart, was charged with having assaulted him at the Ohoka on Monday. The constable said at 9 p.m., after the sports, he was near the Jnnction Hotel, Ohoka, when he saw a disturbance taking place outside it, and found accused and another fighting. He tried to stop it, when the accused struck him in the mouth, and said no bobby could take him, Witness got him down, but accused tore his uniform and damaged the handcuffs. He called on the persons near to assist, but they all declined unless he called them by name, being a stranger he could not tell their names, and one man he pointed to and called on went away. The accused, with the assistance of his brother and another, got away, and he had arrested him to-day at Rangiora. The damage to the uniform was estimated at £2 lOa. Accused said he did not remember the occurrence. The Magistrate remarked it was common for persons to say they did not remember, and expect by that means to be dealt with lightly. The police had to be protected, and this seemed to be an unprovoked assault on an officer in the discharge of his duty. Accused was fined £2," and ordered to pay £2 10s, value of the uniform, or in default undergo one week's imprisonment.
