Monday. February 17. - [Before G. L. Mellish, Esq, R.M, O. Dudley, Esq, J.P, E. G. Kerr, Esq, Mayor, and Rev J. W. Stack, Maori interpreter.] Drunk and Disorderly—John Miller, an old offender under this charge, who had been arrested by Sergeant Pratt on Sunday, was fined 20.-3 and costs. Publican's License—The license of the Kaiapoi Hotel, at present held in the name of Buruip's trustees by C. Fairweather, as licensee, was transferred to Mr G. H. Wearing. Breach op Public House Ordinance —C. Fairweather was. charged with 'having permitted drinking in the: Kaiapoi Hotel ou Sunday lastl and at his request although he had only been summoned 011 Monday morning the case was heard. Sergeant Pratt stated that from information he received he had- reason to

believe that drinking was permitted in the Kaiapoi hotel on Sunday last. About noon, accompanied by Constable Wildermoth. be entered the hotel by thi; main iv.tr_.-ic- from the..street; He, found the bar open, and J. Moore, sen., at the bar with a glass standing on the counter before him wich liquor in it. He went into the back sitting-room where he saw four men, three of whom were not lodgers at the hotel, with beer pots before them. ti»at in frout of one of them having a quantity of beer iv. it. By defendant—Did not see the barman supply any drink. "Constable Wilderrnoth stated that on Snuday at midday he. weut with last •witness to Che Mainp i fL-hl. They went in by the fioat door. Mr Wearing—l'he barman w-*._ behind the bar aad Moore was standing in; front of the b:ir. .He7saw the barman draw back a glass from Moore, and as Sergeant Pratt and he (witness) went la to the other rooms, put it back again to Moore. ;In the back room he saw the parties referred to by the Sergea.it, and saw one of them ju?t putting the beer measure from his lips. John Miller was called. He said he was at the Kaiapoi hotel on Sunday last. He had a "lass of liquor, which was supplied by the baraian, and for which he paid. The defence set up by Mr Fairweather was that several of his men had been staying a t the hotel over Saturday night and; Sunday and were lodgers. These had invited the men found in the back room to the house, and when the police came in some of them slipped out. G. W. Wearing, barman at the hotel, said his instructions were to serve no oue except lodgers with drink on' Sundays. The men who had been staying at the house had beer that day. It was they who invited the three referred to in. He refused to supply any liquor to one of the three when he asked for it. He supplied none to Miller. John Moore, senr., called also for tbe defence, said he had taken a pair of boots in to the Kaiapoi Hotel. No driuk was supplied to him. The Bench considered the case clearly proved, and fiued defendant £5 aud costs:

Civil Cases.—S. Stone, v, R. and J. Seawood. No appearance of the plaintiff. G. Patterson v VV. Smith, claim £2 ; the plaintiff sued for. au amount which he had paid defendant in excess of his wages. A nonsuit was recorded. During the hearing of the case an unstamped receipt, : give by defendant, was handed in, upon which he will be'proceeded -against under the Stamp Act. A. Dickie v J. Murphy, claim £2 ; no appearance of defendant. Judgment for plaintiff. Same v Fetow (a Maori), claim £2 os, for services "of "Balmoral, an entire lior.se.. The plaiutiff denied that his mare had a foal, and another Maori,-named Paul, denied the agreement which'plaintiff stated had been made. . A nonsuit-was recorded. Belcher and Fairweather v Houlton and Co, claim £2 18s 6d; judgment for plaintiff, defendants not appearing.
