EDUCATION BILL.
1. That out of thc public revenues of the said Province there shall be paid annually for Educatonal purposes during the five years ending on the 31st day of March, 1867, a sum not exceeding five thousand three hundred and fifty pounds sterling, according to the provisions hereinafter contained, to the several persons and in the several proportions undermentioned respectively, that is to say :— To the Bishop of Christohurch, or other the acting head of tho Church of England Schools within the said Province ........£BOOO To the principal Minister, or other the acting head of thc Wesleyan Body within tho said Province....£looo To the principal Minister or other the acting head of the Presbyterian Body within the said Province...£looo To the Inspector of Schools, as hereinafter appointed, a yearly salary of £300, and a further forage allowance of £50 £ 350 2. The Provincial Treasurer shall pay such sums to the persons hereinbefore named, in such portions and at such time 3as the Superintendent shall, by any warants under his hand, from time to time direct, and shall be allowed credit in hia accounts for all sums so paid; and the receipt of the persons above-named, or of any persons lawfully authorised to receive such monies in their behalf respectively, shall be a full discharge to the Provincial Treasurer for the sum or sums' for which such receipts shall be given. 3. That thc suras or any portions of them, hereby paid to the heads of the Religious Bodies above-named, shall bo expended by them in aid of the maintenance and establishment of Schools within the Province of Canterbury, according to rules and regulations to be issued by the Superintendent, with tho advioe of tho Executive Council, and published in the ' Provincial Government Gazette.'
4. Every Sohool which shall be aided by the grants hereby made, shall bo placed under the management of one of thc acting heads of the Religious Bodies hereinbefore named; and such head shall have the appointment and removal of the teachers, and shall have control over all the instruction, both religious and secular, in any such School. 5. That if any parents object to tho attendance of tho ; r children during the times set apart for instruction in tho doctrines of religion in any such School, such attendance shall not be required. 6. That the School Fees shall be the same in all Schools of the same class, receiving aid out of the sums hereby granted; and tbat a scale of fees, together with a scale of salaries proportionable to average attendance, shall be determined by the Superintendent and Executive Council, in consultation with the heads of the several Religious Bodies above mentioned, and the Inspector of Schools hereinafter appointed. 7. There shall be an Inspector of Schools who shall be appointed and removable by the Superintendent, with the advice of the Executive Council. 8. Such Inspector shall have power to inspect and examine all schools wholly or in part maintained out of the grants hereby made and to require the managers and teachers of any such school to furnish full information as to thc course of secular instruction carried on therein and as to the attendance of the children and as to the school fees received and the expenditure of any portion of the sums hereby granted in the support of such school and shall report thereon to tho Government. Provided that the Inspector shall not examine into or report upon the religious instruction carried on in any suoh sohool.
9. If the Superintendent and Executive Council shall be satisfied, upon the report of the Inspector, that the secular instruction carried on in any such School is not satisfactory, or that the manager or teachers of any such school, have refused or neglected to afford such information as the Inspector is hereby authorised to require or to afford proper facilities for the examination and inspection of such School, it shall be lawful for the Superintendent, with the advice of the Execvtivc Council, to withhold the application of any
portion of; the sums hereby granted to such School, for so long as he shall think fit.
10. Detailed accounts shall be furnished quarterly to the Superintendent by the head of each religious denomination of the expenditure of the grant received by it. Such accounts, together with the reIrorts furnished by the Inspector, shall be aid before the Provincial Council. 11. In tl>ei interpretation of this Ordinance the words "The Bishop of Christchurch or others the acting heads of the several religious denominations hereinbefore mentioned," shall, be deemed to include the Church pf England Synod or any otber body, of Trustees or (yomnjittee' of School-management with whom the head of each denomination may co-operate in the distribution of the several sums! hereby granted. 12. This Ordinance shall come into operation on the Ist day of April, 1862. 13. This Ordinance shall be entitled and may be cited as the '' Second Educa-. tion Ordinance," Sess. No.
