HERRIES BEQUEST
Matters concerning the bequest left to the Borough by the late Sir William Merries claimed attention at Wednesday night's meeting of the Borough Council. The District Public Trustee, * Auckland, wrote in reply to u letter from the Council, advising that payment fur the proposed footpath, kerbing and channelling along the Merries Memorial Gardens may be covered out of the legacy bequeathed by the late Sir Wm. Merries to the borough, so far as the balance of the legacy unpaid extends. The Town Clerk, in a letter to the Public Trust Office, inquired whether the Council would be in order in expending a portion of the Merries bequest in placing seats, planting, beautifying and suitably fencing a site on the hillside at a point in Devonport Road near the Ninth Avenue intersection, such enclosure to be opened to the public. There is a view from this point of the bowling and tennis grounds immediately below, as well as a comprehensive view of the harbour, and it is thought lifting that part of the besuest should be expended in this—the south end of the town. The District Public Trustee, Auckland, advised that it is considered that the work specified is such as may ho paid for out of the deceased's legacy to the borough. The letter also staled: ''When applying for a payment on account of the legacy to cover this work I shall be pleased to receive from you an assurance that no provision lor such work has been made out of the borough rates." The communications were received,. It was decided that the Works Comjnittee confer with the deputation which had wailed upon the Council in regard to the beautifying of the area near the intersection of Devonport Road and Ninth Avenue.
