Wednesday, 12th November, 1579. (Before E. H. Carew, Esq., R.M.) KAITANGATA ROAD BOAED V. WM. POPPLEWELL. Claim, £16 2s 9.1, for rates. Mr D. Reid appeared for the Board, and Mr W. Popplewell, junr., appeared on behalf of his father, the defendant, who was au invalid, and admitted indebtedness to the amount of SJI os 9d, and pleaded paymeut of £(" ss, and not indebted for balance, J*2 12. Mr Reid admitted that £Q 5s of the amount sued for had been paid, and was prepared to take judgment for amount admitted. (■
Judgment for £7 5s 9J, ; Court oosts, ISs, and professional foe, 21s. ALfcX. SWHAN V, DAVID MURRAY, Claim, £113 7s 61, (reduced to JIOO to bring witbin jurisdiction of Court), for rent of premises at Slopedown District. Mr Taylor appeared for plaintiff, and Mr D. Reid for defendant. Thomas Watson Bruce, station manager, produced lease duly executed by parties, and at tested by witness. Plaintiff deposed that defendant owed him one year's rent, £163 7s 6d, less oash received, £50. To Mr Reid — He had a conversation with defendant at tbe Waipahi Hotel, re the lease about six weeks ago. He couldn't remember what took place. He had not a good memory. This closed the plaintiff's case, and Mr Reid called The defendant, who deposed that he had occupied the land in question for about 18 months, and had erected a five-roomed cottage thereon, at a cost of L 240. About six weeks ago, just When the rent fell due, he met the plaintiff at Waipahi, and asked him if he would accept a surrender of the lease, take all the improvements, and release him from all responsibility. The plaintiff agreed to this, and allowed him 14 days time to remove stock. He sent word to plaintiff of his intention to muster on a particular day. He then sold the whole of his stock, and gave up possession of the land, with the building and improvements. After he left the hotel, plaintiff asked for a written surrender. Witness then requested him to go hack to hotel and he would sign one. Plaiutiff refused, but requested him to forward one through the post. He had not done this because he did uot thick it was of very much impoi tance. After argument of the legal points of the case, his Worship reserved judgment till nexfc Court day.
